MyChart Terms and Conditions

You are being provided access to the MyChart web site through The Methodist Hospitals, Inc. To access MyChart, you must agree to be bound by these the terms and conditions set forth below. If you do not agree to these terms and conditions, you may not use the MyChart web site.

Information Available on MyChart
Information available on MyChart is provided “as is” without warranty of any kind and is meant for use only to support web-based access to portions of your Methodist Hospital medical record. I understand that The Methodist Hospitals, Inc. has the sole authority to determined and/or limit the scope of medical record information maintained electronically and made available via MyChart web-based access, in compliance with applicable Federal and State law.

Results
Not all results are available on MyChart. Only non-sensitive outpatient results will be displayed after 4 days of the resulted time. Abnormal results will not be available on MyChart.

MyChart ID and Password
I understand that I will create a unique identification (ID) code and password to be used to access my health information via MyChart. I understand that this ID and password are unique codes that identify me in the MyChart computer system. Inquiries and entries that I make via MyChart will be logged with my identity.

I understand that it is extremely important that I keep the ID and password that I use to access MyChart confidential. If at any time I feel that the confidentiality of my password has been compromised, I will change my password. I understand that The Methodist Hospitals, Inc. takes no responsibility for and disclaims any and all liability or consequential damages arising from a breach of medical record confidentiality resulting from my sharing or losing my password. If The Methodist Hospitals discovers that I have inappropriately shared my password with another person, or that I have misused or abused my MyChart access privileges in any way, my participation in MyChart may be discontinued by The Methodist Hospitals, Inc. without prior notice.

Release of Information Request
I authorize The Methodist Hospitals to release my personal health information to me via MyChart. I understand that I may revoke this authorization at any time in writing.

Audit
I understand that my activities within MyChart may be tracked by computer audit and that any entries I make and messages I send may become part of the medical record.

Users Must Be 18 Years of Age
MyChart is available only to individuals over the age of 18. By applying for access to MyChart you represent that you are not under the age of 18. In addition, you agree to be responsible for (a) prohibiting use and/or access to your MyChart account by those under the age of 18; and (b) limiting access to your computer or the Internet to the extent necessary to restrict access to MyChart to those over the age of 18. Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section below.

Proxy Access
Individuals age 18 or older may request proxy access to another individual’s MyChart account by completing a Proxy Access Form and submitting it to Methodist Hospitals. Such access will only be granted to individuals with parental rights or legal rights over the MyChart patient/account holder and only to the extent that the individual requesting proxy access can demonstrate the legal right to the account holder’s medical information. Full MyChart proxy access is available for children up to age 13 but limited between the ages of 13 and 18. A MyChart account will be activated for both the proxy and the account holder. If the proxy’s legal relationship with the account holder changes, the proxy must inform Methodist Hospitals immediately by calling the Health Information Management Department from 8am-4pm Monday through Friday at 1-219-738-5586. Methodist Hospitals and your provider reserve the right to revoke proxy access at any time for any reason.

Services and Responses
Methodist Hospitals will use reasonable efforts to provide a timely response to electronic messages. While the anticipated turnaround time is two (3) business days during normal office hours, this is only an estimate and not a binding a commitment. Thus, if you determine a more urgent response is necessary, it is your responsibility to follow up and/or schedule an appointment if warranted. At this time, the following services are available through MyChart:

Privacy
Methodist Hospitals will, at all times, use reasonable efforts to maintain the confidentiality of your confidential medical information and will not disclose any such information to any unaffiliated third party unless you authorize that person to receive your information or the information is permitted to be disclosed by law. All messages sent and received within MyChart that contain medical information are subject to all state and federal laws governing the security and confidentiality of medical records.

Communications
You will be notified via e-mail when there is new information to be viewed on MyChart account. Therefore, this means that any person with access to your e-mail will be able to see this notification; this could include your spouse, employer or anyone else that can access your e-mail account. Although no private medical information will be sent via e-mail, the notification that new medical information is available by accessing MyChart may be information that you would not want others to know. Thus, you should take into account who has access to your e-mail address when providing an e-mail address for such notices to be sent.

Firewalls, passwords, encryption and other periodic quality oversight activities are used to safeguard your information and the communications between you and Methodist Hospitals through MyChart (the "Security Measures"). While such Security Measures are used, you agree that Methodist Hospitals shall not be liable for the failure of such Security Measures unless such failure is due to Methodist Hospitals’ gross negligence or willful misconduct.

Appropriate Use
Access to MyChart is granted to users for their convenience and to share information related to their medical care. Your use of the system unrelated to this purpose may result in the suspension or termination of your access privileges. Improper activities include, but are not limited to, the use of inappropriate or abusive language, reserving appointment times that are not needed or are frequently cancelled and other activities that are deemed to cause a disruption to clinic operations in the sole discretion of Methodist Hospitals.

You agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Methodist Hospitals has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Methodist Hospitals has the right to suspend or terminate your account and refuse any and all current or future use of the MyChart services (or any portion thereof).

If your use of MyChart violates these Terms and Conditions, Methodist Hospitals reserves the right to permanently terminate access to MyChart.

You can disenroll from your use of MyChart at any time by calling the by calling the Health Information Management Department from 8am-4pm Monday through Friday at 1-219-738-5586.

Disclaimer
With respect to any electronic communications you send, your health care provider is only able to respond to such communications based on the information you have provided. If there is insufficient information provided or an appointment is needed, your health care provider will be unable to provide accurate and reliable services through MyChart.

Methodist Hospitals assumes no responsibility for how you use the information you obtain from MyChart. You should consult with a physician or other health care provider regarding your own condition and how the information in MyChart applies to you. MyChart access is not a substitute for consultation with your physician and MyChart does not include your entire medical record. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.

Methodist Hospitals may restrict or terminate access to MyChart at any time, including, but not limited to times, where maintenance of the MyChart system is needed or you have violated these Terms and Conditions. Access is provided on an "as is available" basis and you agree that access is not guaranteed at any particular time. You agree that Methodist Hospitals shall not be liable to you for any modification, suspension or discontinuance of the MyChart services (or any part thereof).

You agree to hold harmless Methodist Hospitals should any information be lost while communicating online or if any information is disclosed to any other individual communicating with Methodist Hospitals using your MyChart account.

THE MYCHART SERVICES AND SYSTEM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. METHODIST HOSPITALS AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. METHODIST HOSPITALS MAKES NO WARRANTY OR REPRESENTATION THAT (a) THE MYCHART SERVICES OR SYSTEM WILL MEET YOUR REQUIREMENTS; OR (b) THE MYCHART SERVICES OR SYSTEM WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT METHODIST HOSPITALS AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE TO YOU FOR ANY PUNITIVE, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA OR OTHER INTANGIBLE LOSSES (EVEN IF METHODIST HOSPITALS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE MYCHART SERVICES AND SYSTEM; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OF DATA THROUGH THE MYCHART SERVICES AND SYSTEM DUE TO NO FAULT OF METHODIST HOSPITALS; OR (iii) STATEMENTS MADE BY, CONDUCT OF, OR ANY INFORMATION, SERVICES OR GOODS PROVIDED BY A THIRD PARTY.

Links and Third Party Information
Methodist Hospitals, through MyChart, may provide, or third parties may provide, links to other World Wide Web sites or resources. You acknowledge and agree that Methodist Hospitals is not responsible for the availability of such sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Methodist Hospitals shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

Governance
This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana without regard to its conflict of law provisions and any dispute, claims or causes of action (regardless of theory) arising out of or relating to these Terms of Conditions or the relationship between you and Methodist Hospitals shall be exclusively brought and exclusively maintained in a federal or state court with competent jurisdiction in Indianapolis, Indiana. You and Methodist Hospitals agree to submit to the personal jurisdiction of courts located within Indianapolis, Indiana and agree to waive any and all objection to the exercise of jurisdiction over the parties by such courts and to venue in such courts.

These Terms and Conditions constitute the entire agreement between you and Methodist Hospitals and govern your use of the MyChart services. The failure of Methodist Hospitals to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions shall remain in full force and effect.

These Terms and Conditions are effective until terminated by either you or Methodist Hospitals. Methodist Hospitals may terminate these Terms and Conditions, with or without advance notice.

BY USING MYCHART AND CLICKING ON ACCEPT, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND REPRESENT THAT YOU HAVE READ AND UNDERSTOOD ALL OF THESE TERMS AND CONDITIONS.
